Sensitive handling
THE CONSTRUCTION of the Sardar Sarovar dam which calls for resettlement of a whole tribal population whose living is forest and river-centered, requires sensitive handling. What manner of development is it which sacrifices humanity and uproots a large
population and plants an unmanageable burden on cities.
The National Human Rights Commission constituted by ex-Judges of the Supreme Court and State Human Rights Commissions are all constituted as a mandate of the Constitution to be defenders of the people for sensitised adjudication
of people’s conflicting interests in the national and state level. So, the Supreme Court ought to have heard the National Human Rights Commission, States Human Rights Commissions and expert bodies in this matter for any decision given is illegal, in legal
jargon, for failure to implead and hear essential statutory parties.
